Pitbull Rabble Razr Phone Sweepstakes

 

OFFICIAL RULES

 

Sponsors. TeeVee Toons, Inc. d/b/a TVT Records ("TVT"), the recording artist professionally known as "Pitbull" and Rabble (the "Sponsors").

 

Eligibility. Only legal U.S. residents, who are 14 years of age or older at the time of entry, may participate in The Pitbull Rabble Razr Phone Sweepstakes (the "Sweepstakes"). The Sweepstakes are void where prohibited by law, or where the registration or filing requirements of any state or local jurisdiction have not been complied. The Sweepstakes are not open to employees of TVT or any of their respective representatives, subsidiaries, affiliates, advertising and promotion agencies, family/household, Pitbull, Rabble or any of their respective employees, representatives, subsidiaries, affiliates, advertising and promotion agencies, family/household members are also not eligible.

 

NO PURCHASE NECESSARY TO ENTER OR WIN. Entrants are neither encouraged nor required to purchase any product or service in order to enter the Sweepstakes.

 

To Enter. Only one entry per person will be accepted (any subsequent entries will not be considered). To enter, each entrant must visit http://www.pitbullmusic.com/giveaway/rabble/ (the “Entry Site”) and follow and complete the Sweepstakes entry directions:

 

(1) Read and agree with these official Sweepstakes rules - submission of an entry into the Sweepstakes affirms that you have read and accepted the Sweepstake rules;

 

(2) ENTER ONLINE: Log onto the Entry Site. You will be asked to provide your full name, address, telephone number, date of birth, gender and (if applicable) e-mail address and to answer the additional questions asked. Upon submitting the completed information, you will receive one (1) Online Entry in the Sweepstakes.  ALL ENTRIES ON THE ENTRY SITE MUST BE RECEIVED BY 12:00:00 AM (EST) ON AUGUST 7, 2006. ONLY ONE (1) ONLINE ENTRY WILL BE ACCEPTED PER PERSON; OR

 

(3) ENTER BY TEXT MESSAGE: Using your wireless cellular phone, send a SMS or MMS picture message to “pitbull@rabble.com” to be automatically entered into the promotion. Normal charges apply for text messaging based on your current feature subscription; OR

 

(4) ENTER BY EMAIL: Send an email to pitbull@rabble.com with your full name, address, and age. Upon sending a complete email, you will receive one (1) Online Entry in the Sweepstakes.  ALL ENTRIES VIA EMAIL MUST BE RECEIVED BY 12:00:00 AM (EST) ON AUGUST 7, 2006. ONLY ONE (1) ONLINE ENTRY WILL BE ACCEPTED PER PERSON; OR

 

(5) ENTER BY MAIL:  On a postcard, handprint (no mechanical reproductions accepted) your full name, address, telephone number, date of birth, gender and (if applicable) e-mail address. Mail your completed entry to: PITBULL RABBLE RAZR PHONE SWEEPSTAKES, c/o TVT Records, 23 E. 4th Street, New York, NY 10003. (“Mail-in Entry”).  ALL MAIL-IN ENTRIES MUST BE POSTMARKED BY AUGUST 7, 2006 AND RECEIVED BY AUGUST 11, 2006.  ONLY ONE (1) MAIL-IN ENTRY WILL BE ACCEPTED PER PERSON.

 

Sweepstakes Submissions Deadlines. Entries must be submitted and received by TVT between June 5, 2006 at 12:01:00 a.m. EST, and August 7, 2006 at 12:00:00 a.m. EST, to be eligible to win. Mailed entries must be postmarked on or before August 7, 2006 at 12:00:00 a.m. EST, and must be received by TVT by August 11, 2006 at 6:00:00 p.m. EST, to be eligible to win. The Sponsors are not responsible for any lost, stolen or undelivered entries, or any entries not received within the applicable Sweepstakes periods mentioned above. TVT reserves the right to suspend or cancel the Sweepstakes in its sole discretion. The Sponsors reserve the right to select winners from among all eligible entries received prior to the suspension or cancellation date. TVT further reserves the right to modify the rules of the Sweepstakes in any way or at any time, as long as reasonable notice is posted on http://www.pitbullmusic.com/giveaway/rabble/.

 

Winner Selection. One (1) first place winner (the “Winner”) will be selected from among all eligible entries received. As stated above, the Sweepstakes closes on August 7, 2006. The Winner will receive one (1) Motorola Razr phone loaded with Rabble and $500 cash. The Winner (or his/her parent/guardian if Winner is a minor) will be required to execute (a) an affidavit of eligibility, (b) a promotional release, (c) a release of liability, (d) compliance with the Sweepstakes rules, and (e) any relevant tax documentation. The promotional releases to be signed by the Winner will explicitly grant TVT the right to use the Winner’s likeness, biographies, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation via any and all media now known or hereafter devised (including, without limitation, Internet and television) in perpetuity. The Winner must complete and return all legal documents within five (5) business days after receipt. Noncompliance will result in disqualification of the Winner and an alternate winner will be selected by TVT from remaining eligible entries. Prizes will be delivered to the legally qualified Winner within 60 days of TVT's receipt of all necessary legal documents. All Federal, state and local tax liabilities are the responsibility of the winner. Acceptance of the prize constitutes permission (except where prohibited) for the Sponsors and their respective designee(s) to use the Winner’s likeness, biographies, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation.

 

Prizes. As stated above, the Winner will receive one (1) Motorola Razr phone loaded with Rabble and $500 cash (the “Grand Prize”). No substitution for the Grand Prize (or parts thereof) by the Winner will be allowed. The Grand Prize (or parts thereof) is not transferable, assignable, or redeemable for cash. If necessary, due to unavailability of the Grand Prize (or parts thereof) for any reason, a comparable prize will be awarded at the sole discretion of the Sponsors.

 

Winner Notification. The Winner will be notified by e-mail, phone or first-class mail within five (5) business days of winning. If the Winner does not respond within five (5) business days after date of notice from TVT, an alternate winner may be selected by TVT. The Sponsors shall not be liable for (1) failed, returned or misdirected notifications based on inaccurate information provided by the Winner or (2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind. The Winner will be given five (5) business days from the first day of notification to respond to claim prize(s). A non-response by the Winner or non-receipt of notification response after the specified five (5) business days will be considered a forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

 

Odds of Winning. Odds of winning depend on the number of entries received. Entries will not be limited, except as expressly provided hereby.

 

Miscellaneous. By participating in the Sweepstakes, entrants agree to be bound by these rules and by the decisions of the Sponsors, which are final in all matters relating to the Sweepstakes. Prizes are nontransferable. Arrangements for the fulfillment of all prizes will be made by TVT. Receipt of any prize is conditioned upon compliance with any and all applicable federal, state and local laws, rules and regulations. The winner of any prize(s) will be solely responsible for payment of all federal, state and local taxes.

 

Releases. By participating, entrants agree that the Sponsors and those involved in the development, production (including prize suppliers), implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, the Sweepstakes, including entry and participation in the Sweepstakes and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to the Sweepstakes, they will indemnify Sponsors from any and all such claims, including the attorneys' fees related thereto. The Sponsors shall not be responsible for any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from downloading as part of the Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes will be ineligible for prizes and may be prosecuted to the full extent of the law. The Sweepstakes shall be governed by New York law. By participating in the Sweepstakes, entrants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to the Sweepstakes and that venue shall be a competent court within the County of New York.

 

Official Rules and Winner's List. The entrants' names and submissions may be posted on-line. To receive a copy of the Official Rules, or for the name of the Winner, send a self-addressed stamped envelope to: The Pitbull Rabble Razr Phone Sweepstakes, c/o TVT Records, 23 E. 4th Street, New York, NY 10003. Specify “Winner's List” or “Official Rules” on your request. Requests received after August 21, 2006 will not be honored.

 

General Conditions. The Sweepstakes is void where prohibited by law and is subject to all applicable Federal, state, and local laws and regulations. In the event of non-compliance by the Winner with the official rules of the Sweepstakes, an alternative winner may be awarded the respective prize. Return of any prize or prize notification as undeliverable will result in a disqualification and an alternate winner may be selected. All prizes will be awarded. The Winner is solely responsible for all taxes on prizes. All incidental expenses will be the responsibility of the Winner.

 

Entrants release and waive any claims they may have against releasees for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney’s fees) resulting from acceptance, use, or misuse of any prize or element thereof, or from participation in this Sweepstakes.

 

If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors’ sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof.  In the event this Sweepstakes is cancelled, the Sponsors will conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation.  If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  If a dispute arises about who submitted an entry on the Entry Site, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  A potential winner may be requested to provide Sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.

 

Note: Internet entry must be made by the entrant only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes.  The use of any device to automate the entry process is prohibited.
